Terms of service

Plain English. Fancy Planties is a plant-care tracker. Use it honestly, don't abuse the service, and don't scrape or reverse-engineer it. Your plant photos and notes belong to you. We need a licence to display them back to you inside the app. We can suspend accounts that break these rules. The privacy details are in the privacy policy.

1. The agreement

These terms govern your use of the iOS app Fancy Planties and the web app at fancy-planties.com. Fancy Planties is operated as a sole proprietorship by Stefan Bekker ("we", "us"). By creating an account or using the app, you agree to these terms. If you do not, do not use Fancy Planties.

2. Eligibility

You must be at least 13 years old to use Fancy Planties. Accounts created by anyone under 13 will be removed when we become aware of them.

3. Your account

You are responsible for keeping your sign-in credentials safe.
One account per person. Do not impersonate another person or organization.
To delete your account, email support@fancy-planties.com. See the privacy policy for what gets removed.

4. The service

Fancy Planties is free to use. There are no subscriptions and no in-app purchases. We reserve the right to introduce paid features in the future; if we do, we will give advance notice and existing free functionality will remain available at our discretion.

The care guides and schedules in the app are general informational content, not horticultural advice. We make no warranty that any care guidance is accurate, complete, or suitable for your specific plants.

5. Your content

Plant photos, nicknames, notes, and care records you create are yours. By adding them to Fancy Planties, you grant us a worldwide, non-exclusive, royalty-free licence to store, display, and transmit your content solely to operate the service for you. This licence ends when you delete the content or your account.

When you upload content, you confirm it does not infringe anyone else's rights, does not disclose private information about other people, and is not obscene, harassing, hateful, or otherwise unlawful.

6. Acceptable use

Do not:

Scrape, mass-download, or systematically harvest data from the app or API.
Reverse-engineer the app or attempt to access systems or data you are not authorized to access, except to the limited extent permitted by applicable law.
Use the service to send spam, distribute malware, or harass other users.
Create accounts to circumvent a suspension or ban.
Use automated means to interact with the service without our written permission.

7. Enforcement and termination

We can suspend or terminate access for serious or repeated violations of these terms. We will tell you when we suspend an account where it is reasonable to do so. You can stop using the service and request account deletion at any time by emailing support@fancy-planties.com.

Sections that by their nature should survive termination — content licences for content already stored, disclaimers, the liability cap, and the governing law clause — survive.

8. App stores

If you obtained the iOS app from the Apple App Store, your use is also subject to Apple's Licensed Application End User License Agreement. Apple is not responsible for Fancy Planties and provides no support for it; we are responsible for both.

9. No warranty; limitation of liability

Fancy Planties is provided "as is". To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data. Where law does not allow these limits, our aggregate liability is capped at the greater of US$50 or the amount you paid us in the 12 months before the claim. Nothing in these terms limits any non-waivable consumer right you hold in your home jurisdiction.

10. Changes to the service and these terms

We can change Fancy Planties and these terms over time. For material changes, we will surface a notice in the app and update the "last updated" date above before the change takes effect. Continuing to use the service after a change means you accept the new terms; if you do not, delete your account.

11. Governing law

These terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-laws rules. Disputes go to the state and federal courts of the State of Georgia, except that where local consumer law gives you a non-waivable right to bring a claim in your home jurisdiction, that right is preserved.
